Terms and Conditions of Use

1 The service

Agendamix is a management system for appointment-based businesses, such as salons, barbershops, clinics and studios. It brings together calendar, customer records, services, packages, finances, reports, team and Online Booking, a public page where the business customers book appointments and receive confirmations and reminders on WhatsApp.

Features may be improved, changed or replaced over time, always aiming to keep what is essential to your daily work.

2 Account, team and password

• To use Agendamix you must create an account with true information and keep it up to date. You must be at least 18 years old.
• The account owner can add professionals and team users and is responsible for what they do in the app.
• Each person must keep their password secret. If you suspect misuse, change the password and let us know.

3 Trial period

Every new account gets a 15-day free trial, with no payment method required. At the end of the trial, you need to subscribe to a plan to keep using the service.

4 Plans, prices and payment

• We offer Monthly and Yearly plans. The price depends on the region of the country set in the account and is shown in the app and on the website before payment.
• In Brazil, payment is made through Asaas, by credit card or Pix Automático. In other countries, through Stripe, by credit card. Payment happens on the page of these partners; Agendamix never receives card details.
• The subscription is not sold through the Apple or Google stores; the store billing rules do not apply to it.
• We may change prices. Any change applies from the next renewal and will be announced in advance by email.

5 Renewal, cancellation and refunds

• The subscription renews automatically at the end of each period, with the same payment method, until it is cancelled.
• You can cancel at any time in the app, under Subscription. With Pix Automático, cancelling the authorization in your bank app also ends the subscription.
• After cancellation, access continues until the end of the period already paid, and there are no new charges.
• Cancellation does not entitle you to a refund of the period already paid, except where required by law.

6 Expired subscription

If the subscription expires or a payment is declined, access to the app and to Online Booking is blocked until it is settled. The account data stays stored and comes back as soon as the subscription is renewed.

7 Account deletion

You can delete the account at any time, in the app or on the Delete account page. Deletion is permanent: it erases all business data, ends team access, takes Online Booking offline and, if there is a subscription, cancels it first, with no refund of the period already paid, except where required by law.

8 Responsibilities of the business

• The customer data entered in the app or received through Online Booking belongs to the business. The business is the controller of this data and is responsible for processing it lawfully, including having permission or a legal basis to send messages to its customers.
• The business is responsible for the information it publishes on Online Booking (services, prices, hours, professionals and logo) and for the services it provides.
• Do not record sensitive customer data in the app, such as health information, religion or sexual orientation.

9 Prohibited use

You may not use Agendamix for illegal activities, to send unwanted messages, to try to access data of other accounts, to interfere with the operation of the service, or to copy, resell or reverse engineer the software.

10 Availability and liability

• We work to keep Agendamix available and make daily backups, but interruptions may happen for maintenance or because of failures beyond our control.
• WhatsApp messages depend on WhatsApp itself and on the customer number; we do not guarantee that every message is delivered.
• Agendamix is not liable for losses caused by incorrectly entered information, by misuse of the account by third parties using the user password, or by unforeseeable events and force majeure.

11 Intellectual property

The Agendamix brand, the app, the website and their content belong to DelphinosDev and are protected by law. The subscription grants the right to use the service, without transferring any right over it. The data you enter remains yours.

12 Suspension

We may warn, suspend or close an account that breaches these Terms or the law, or that puts the service or other users at risk. Whenever possible, we will notify you by email first.

13 Changes to these Terms

We may update these Terms. The date of the last update is shown at the top of the page and, if the change is important, we will let you know by email or in the app before it takes effect.

14 Governing law and jurisdiction

These Terms are governed by the laws of Brazil. The courts of the city of São Paulo, Brazil, have jurisdiction, without prejudice to any mandatory consumer protection rules of your country of residence.
